Terms of Service

1. Acceptance of terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Refund Policy, and Cookie Policy. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. The Service

nabh.cloud is a prepaid, INR-denominated API marketplace that provides unified, OpenAI-compatible access to a catalogue of third-party large language models and related AI models (text generation, embeddings, image generation, and speech-to-text). We act as a gateway and billing layer; model inference is performed by upstream cloud providers.

3. Eligibility and accounts

• You must be at least 18 years old and capable of forming a binding contract under the Indian Contract Act, 1872.
• You are responsible for the accuracy of the information you provide and for all activity under your account.
• You must keep your login credentials confidential and notify us promptly of any unauthorised use.

4. API keys and security

API keys (prefixed nbh_) authenticate requests to the Service and are tied to your wallet balance. You are solely responsible for keeping keys secret. We store only a hashed representation of each key and cannot recover the original value. You may rotate, restrict by IP, set expiry on, or revoke keys at any time from your dashboard. All usage billed against a key is your responsibility, including usage resulting from a leaked key.

5. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation, including the Information Technology Act, 2000 and rules made under it.
• Generate or distribute content that is unlawful, infringing, defamatory, or that sexually exploits or endangers minors.
• Attempt to bypass rate limits, wallet checks, authentication, or other technical controls.
• Resell, sublicense, or expose the raw Service to third parties in a manner that competes with nabh.cloud, except through your own application.
• Send personal, sensitive, or confidential data of others without a lawful basis to do so.

We may suspend access immediately where we reasonably believe usage threatens the security, integrity, or availability of the Service or violates these Terms.

6. Prepaid wallet, fees, and taxes

• The Service operates on a prepaid wallet model. You add credits in Indian Rupees (₹) and usage is deducted per request based on tokens consumed and the per-model rate.
• New accounts receive promotional free credits, which carry no cash value and may expire or be withdrawn at our discretion.
• The Pro plan carries a recurring monthly subscription fee in addition to usage.
• Prices are displayed in ₹ and are exclusive of applicable taxes (including GST) unless stated otherwise. You are responsible for any taxes arising from your use.
• Payments are processed by our payment partner, Razorpay. We do not store your full card or bank details.

All purchases are final. Please review our Refund Policy before adding credits or subscribing.

7. Third-party models and AI output

Model outputs are generated by third-party models and may be inaccurate, incomplete, offensive, or otherwise objectionable. Output is provided “as is” without warranty. You are responsible for evaluating output before relying on it, and you must not use the Service for decisions that require professional (legal, medical, financial) judgement without independent verification. Availability of any specific model is not guaranteed and may change.

8. Intellectual property

The Service, including its software, design, and trademarks, is owned by Habilesoft Pvt. Ltd. and protected by law. As between you and us, you retain rights to the inputs you submit and, to the extent permitted by the upstream provider, the outputs you receive. You grant us a limited licence to process your inputs solely to provide the Service.

9. Service availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features, models, or pricing with reasonable notice where practicable. Scheduled maintenance and upstream provider outages may affect availability.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill.

11. Indemnity

You agree to indemnify and hold harmless Habilesoft Pvt. Ltd. and its officers, employees, and partners from any claim arising out of your use of the Service, your content, or your breach of these Terms.

12. Suspension and termination

We may suspend or terminate your account for breach of these Terms, non-payment, or where required by law. You may stop using the Service and close your account at any time. Any unused wallet balance at termination is treated in accordance with our Refund Policy.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts of India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

14. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance.
